OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

YOU ACKNOWLEDGE AND AGREE THAT THE USE OF WEATHER DATA AND OCEAN CONDITION INFORMATION FOR WATER ACTIVITIES INVOLVES INHERENT RISKS, AND YOU ASSUME FULL RESPONSIBILITY FOR YOUR SAFETY AND THE SAFETY OF OTHERS WHEN ENGAGING IN SUCH ACTIVITIES.

10. Indemnification

You agree to defend, indemnify, and hold harmless Surfing Craft, its affiliates, directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property, privacy, or publicity right
  • Any User Content you submit, post, or transmit through the Service
  • Any decisions made or actions taken based on information obtained through the Service
